​You must be at least 18 years old to purchase, own, or register Nova.Mate. By creating an account or activating Nova.Mate, you confirm that you are 18 years of age or older and legally able to enter into this agreement.

Nova.Mate may be used in environments where individuals under 18 are present or may interact with it. However:

• The registered owner remains fully responsible for all use of Nova.Mate, app, and dashboard, including interactions by minors.

• Nova.Mate is not designed for unsupervised use by anyone under 18. If minors engage with Nova.Mate, it must be under the supervision and responsibility of the adult owner.

Chapter 3. What Nova.Mate Does

Nova.Mate is an AI-powered interactive product designed to provide conversation, companionship, and light assistance through voice and text interaction.  Services include the physical Nova.Mate and its built-in software, mobile and web applications connected to Nova.Mate, and any online dashboard, cloud features, or updates provided by Spiritify, which enable personalized conversations, emotional support, memory care and other helpful features.

Nova.Mate is intended for personal, non-commercial use by adults aged 18 or older.  It is not a medical, therapeutic, or emergency service and should never replace human care, professional advice, or medical consultation.

Chapter 4. Account and Security

You may need to create an account to use certain features.

You agree to:

• Provide accurate information during registration.

• Keep your login credentials secure.

• Notify us immediately of any unauthorized use.

Spiritify Inc. is not responsible for losses caused by unauthorized access if you fail to keep your account secure.

Nova.Mate uses advanced artificial intelligence to provide natural, empathic conversations.

Please understand:

• Nova.Mate’s responses are AI-generated and may occasionally be inaccurate or incomplete.

• Nova.Mate does not provide medical, legal, financial, or emergency advice.

• You remain responsible for any decisions made based on Nova.Mate’s suggestions.

We continuously improve the AI experience, but we can’t guarantee uninterrupted or error-free operation.

Chapter 7. Acceptable Use

You agree not to:

• Use Nova.Mate for unlawful or harmful purposes.

• Interfere with the operation of the app, servers, or connected devices.

• Copy, reverse engineer, or resell any part of the Nova.Mate software or hardware.

• Use Nova.Mate to harass, impersonate, or harm others.

Violation of these rules may result in suspension or termination of your account.

By using the app, you agree to receive these updates automatically.

Chapter 9. Ownership, Intellectual Property and License

You own the physical Nova.Mate that you purchase.  However, all related content, software, and designs are licensed, not sold, to you by Spiritify.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Nova.Mate and its related applications solely for personal, non-commercial purposes. You do not acquire any ownership rights in the software or its underlying technology.

Chapter 10. Third-Party Services

Nova.Mate may integrate with third-party APIs or services (such as cloud infrastructure, large language models, vision models, or cloud storage).

Spiritify Inc. is not responsible for the content or practices of those third parties.

Chapter 11. Limited Warranty and Disclaimer

Nova.Mate is provided “as is” and “as available."  To the fullest extent permitted by law, Spiritify makes no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Spiritify may, at its sole discretion, offer repair, replacement, or refund for Nova.Mate that has a verified manufacturing defect and was purchased directly from Spiritify or an authorized reseller. Any such support is voluntary and limited, and does not create an ongoing warranty obligation or extend coverage to subsequent owners.

This limited option does not apply to damage caused by accident, misuse, modification, improper storage or charging, exposure to liquids, fire, or other external causes. Normal wear and tear and consumable parts (such as batteries) are excluded. Any attempt to open, alter, or repair Nova.Mate by anyone other than Spiritify or an authorized service provider voids eligibility for repair or replacement.

While we strive for the best experience, Spiritify does not guarantee that the app, device, or related software will be uninterrupted, error-free, or permanently available. Service updates, feature changes, or discontinuation of software or cloud functionality do not constitute a defect or breach of warranty.

To the maximum extent allowed by law, Spiritify’s total liability is limited to the repair, replacement, or refund of the original purchase price of Nova.Mate, at Spiritify’s option. Spiritify is not liable for indirect, incidental, or consequential damages, including injury, data loss, or property damage.

​Discontinuation or modification of app, device, or software does not constitute a defect in Nova.Mate. Spiritify is not responsible for loss of functionality resulting from expired or terminated subscriptions, network changes, or software updates.

Chapter 12. Limitation of Liability

To the maximum extent permitted by law, Spiritify's liability under this warranty is limited to repair, replacement, or refund of the Nova.Mate purchase price. Spiritify, Inc. and its affiliates are not liable for any indirect, incidental, or consequential damages arising from your use of Nova.Mate, including injury, data loss, or property damage.

Our total liability to you for any claim shall not exceed the amount you paid (if any) for using the service in the preceding 12 months.

You may stop using Nova.Mate at any time.

We may suspend or terminate access if you violate these Terms or use the app in a way that harms others or the service itself.
